Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Sprig Plant Care mobile application (the "App") operated by Sprig Plant Care ("Sprig," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years of age and that you agree to comply with and be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. These Terms constitute a legally binding agreement between you and Sprig Plant Care.

2. Description of Service

Sprig Plant Care is a mobile application that helps users track and care for their plants. The App provides features including plant watering reminders, plant collection management, plant identification via photo, and plant health assessments. The App is available as a free version with optional premium features available through a paid subscription.

3. User Accounts

The App does not require you to create an account. Your plant data is stored locally on your device. You are responsible for maintaining the security of your device and any data stored on it.

4. Sprig Premium Subscription

4.1 Subscription Plans

Sprig offers optional premium features through auto-renewable subscription plans ("Sprig Premium"). The following plans are available:

Prices are in United States Dollars (USD). Pricing may vary by region and is subject to change. Any price changes will apply to the billing cycle following the date of the price change.

4.3 Free Trial

We may offer a free trial period for Sprig Premium. If a free trial is offered, you will not be charged during the trial period. At the end of the free trial, your subscription will automatically convert to a paid subscription at the applicable rate unless you cancel before the trial period ends. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

4.4 Payment and Billing

All payments are processed through the Apple App Store. By subscribing to Sprig Premium, you authorize Apple to charge your selected payment method at the applicable subscription rate on a recurring basis. We do not collect, store, or process your payment information directly.

4.5 Managing and Canceling Your Subscription

You can manage or cancel your Sprig Premium subscription at any time through your Apple ID account settings:

• Open Settings on your device
• Tap your Apple ID at the top
• Tap Subscriptions
• Select Sprig Plant Care
• Tap Cancel Subscription

Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until your current subscription period expires. Deleting the App does not automatically cancel your subscription.

4.6 Refunds

All subscription purchases are made through the Apple App Store and are subject to Apple's refund policies. To request a refund, please visit reportaproblem.apple.com or contact Apple Support. We are unable to process refunds directly.

5. Plant Identification and Health Assessment

The App provides plant identification and health assessment features powered by third-party AI and machine learning services. You acknowledge and agree that:

• Plant identifications and health assessments are provided as informational suggestions only and are not guaranteed to be accurate.
• You should not rely solely on the App's identification or health assessment for decisions that could affect the safety of humans or animals (e.g., determining whether a plant is toxic or edible).
• When you use the plant identification feature, your plant photo is transmitted to third-party services (PlantNet and/or Google Gemini) for processing. See our Privacy Policy for details.
• Identification and health assessment features require an active internet connection and may be subject to third-party service availability.

6. Acceptable Use

You agree to use the App only for its intended purpose of personal plant care management. You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's functionality or the servers and networks connected to it
• Use automated means to access the App or its services, including bots, scrapers, or similar tools
• Attempt to gain unauthorized access to any portion of the App or its related systems
• Submit content through the plant identification feature that is illegal, harmful, or unrelated to plant identification

7. Intellectual Property

The App, including its design, code, features, graphics, icons, and content, is owned by Sprig Plant Care and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes subject to these Terms.

Photos you take and plant data you create remain your property. By using the plant identification feature, you grant us a limited license to transmit your photos to third-party identification services solely for the purpose of providing the identification and health assessment service.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or free of viruses or other harmful components
• Plant identifications or health assessments will be accurate, complete, or reliable
• Watering reminders will be delivered at the exact scheduled times (delivery depends on device settings, power state, and operating system behavior)
• Following the App's care suggestions will guarantee plant health or survival

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPRIG PLANT CARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sprig Plant Care and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

11. Third-Party Services

The App integrates with third-party services including the Apple App Store, PlantNet, and Google Gemini. Your use of these services is subject to their respective terms and conditions. We are not responsible for the practices, content, or availability of third-party services.

12. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without prior notice. We may also update these Terms from time to time. If we make material changes, we will notify you through the App or by updating the "Last updated" date at the top of this page. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

13. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including ownership, disclaimers, indemnification, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict-of-law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Tarrant County, Texas.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sprig Plant Care regarding the use of the App and supersede all prior agreements and understandings.
